What we do and don’t do

1. We supply components for firearms.  We do not manufacture them.  We cannot guarantee the safety, quality or fitness for purpose of any components you purchase from us (Your Components).

2. Firearms and their components can be dangerous and lethal.  They can cause property damage, personal injury and death.  You should read and understand the manufacturer’s guidelines, instructions of use and safety manuals before using Your Components and any firearms that Your Components are fitted to (Your Firearms).

Using Your Components and Your Firearms

3. Your Components should be fitted by an appropriately qualified person using appropriate skill and expertise.  If you are not an appropriately qualified person with appropriate skill and expertise, you should not fit Your Components to any firearms yourself.

4. A qualified gunsmith or armourer should fit Your Components for you.

5. Your Components should only be fitted to the firearm they are designed for.

6. Improper, unsafe or negligent use of Your Firearms or Your Components can lead to property damage, personal injury and death.

7. If you are unsure about how to safely and properly use Your Firearms or Your Components, or you do not know how to safely and properly fit Your Components to a firearm, you should seek help and advice from an appropriately qualified person.

Lawful, safe and proper use of Your Firearms and Your Components

8. You are responsible for making sure you can lawfully use, own and possess Your Firearms and Your Components.  Different states and territories may have different rules and laws about firearms.  It is your responsibility to comply with those rules and laws.

9. Fitting certain components to a firearm may be illegal or unlawful in certain states or territories.  We do not guarantee that Your Components are allowed to be fitted to firearms in your state or territory.

10. A firearm that is legal without Your Components fitted to it may be illegal if Your Components are fitted to it.

11. If you are unsure if Your Components are allowed to be used or fitted to firearms in your state or territory, you should check with the appropriate government authority in your state or territory before you purchase any components from us.

12. It is your responsibility to make sure Your Firearms and Your Components are used in a lawful, safe and proper way, for a lawful, safe and proper purpose.

Letting others use Your Firearms or Your Components

13. You must not let anyone else use firearms that you own or Your Components unless that is lawful.

14. If you do let someone else use Your Components, you must tell them about this document and what is in it.  It is always your responsibility to make sure Your Components are always used in a lawful, safe and proper way, for a lawful, safe and proper purpose.

What you indemnify us for and release us from

15. (Indemnity) You indemnify us for all loss and damage you or anyone else may suffer as a direct or indirect result of Your Use of Your Firearms and Your Components.  You also indemnify us for all loss and damage caused by anyone who you let use Your Components or Your Firearms.

16. (Release) You release us from all liability, claims, demands, actions, suits and proceedings whensoever and howsoever (whether known or unknown) arising (directly or indirectly) out of Your Use of Your Firearms or Your Components.

17. Your Use includes doing something or not doing something (whether that is negligent or not) that causes loss or damage.

Your agreement

20. By agreeing to purchase components from us and in exchange for us agreeing to supply Your Components to you:

  • you must pay the Purchase Price upon accepting these terms;
  • you agree to the Indemnity and Release;
  • you agree that you have read and understood this document and what is set out in it;
  • you agree that you have had an opportunity to seek and obtain independent legal advice about what is set out in this document;
  • you understand that you are responsible for the lawful, safe and proper use of Your Firearms and Your Components;
  • you understand that we are not responsible for any loss or damage that may be caused by Your Use or someone else’s use of Your Firearms or Your Components,

(together, Your Obligations).

21. If you have any questions about this document, you should seek independent legal advice before you agree to purchase any components from us.

22. It is a term of your agreement with us that you agree to and will comply with Your Obligations. 

Interpretation and governing law

23. (Governing law and jurisdiction) This document is governed by the laws of South Australia and (to the extent they apply) the laws of the Commonwealth of Australia (Governing Law).  You and we submit to the non-exclusive jurisdiction of the Courts of South Australia and (to the extent they have jurisdiction) the Courts of the Commonwealth of Australia and any courts that can hear appeals from them.

24. (Severability) If any provision in this document is unenforceable or invalid under the Governing Law (Offending Provision), that will not affect the validity or enforceability of the remaining provisions and the Offending Provision will be modified to the extent necessary to make it valid and enforceable under the Governing Law, or if that is not possible, the Offending Provision will be removed from this document and the validity and enforceability of all remaining provisions will remain unaffected.

25. (Headings) Headings are used for convenience only and do not affect interpretation.

26. (Plural) The plural includes the singular (and vice versa).

27. (Genders) One gender includes all others.

28. (Operation as a contract) This document operates as a contract and by submitting payment of the Purchase Price, you agree to be bound by the terms in this document (including where payment is made electronically). 

29. (Definitions) In this document:

29.1. Purchase Price means the price that you are notified of at the online checkout at the time of purchasing Your Components from us;

29.2. We, us and our means Precision Ballistics Pty Ltd ACN 647 312 329;

29.3. You and your means the person agreeing to purchase products from us and accepting these terms and conditions.
